STANDARD TERMS OF SALE
The Duct-O-Wire Company, hereafter referred to as the Company, warranty's items sold by it against any defects of material and/or workmanship for a period of one (1) year from date of shipment.
The Company's sole liability shall be to repair at its factory or replace any material returned to it within one (1) year from date of shipment. The Company's responsibility does not cover defects resulting from improper installation or improper use.
Any statement, description, or specification in the Company's literature is for the sole purpose of identification of items and imparts no warranty or undertaking by the Company of any kind.
The Company shall not be liable for economic loss, property damage, or physical injury sustained by the purchaser or by any third party.
No other warranties, expressed or implied, as to the merchantability, performance, or fitness, of the products for their intended use, are made by the Company. This warranty shall only apply to material manufactured by the Company which comprises a complete system.
Based on the customer's clearly written purchase order, the Company will process and ship all orders per the customer's instruction. The Company is not responsible for mistakes or omissions made by the customer when ordering.
List prices and/or discounts are subject to change without notice. Quoted prices will be honored for a period of 30 days from the date of the written quotation unless otherwise stated.
Orders may not be altered or cancelled without the prior written approval of the Company and the customer may be responsible for cancellation charges. Material may not be returned for credit without the prior written consent of the Company. Returned material shall be subject to a 20% minimum restocking charge and be in resalable condition.
All returned material shall be shipped prepaid. Custom parts are not refundable.
Any claims for material shortages/damages must be received by the Company in writing within 10 days of shipment. All claims must be accompanied by copies of the bill of lading and packing slip. Terms of payment are Net 30 Days. A service charge will be incurred on past due amounts. The amount of such charges will be 1-1/2% of the net balance which extends beyond 30 days.
All material is sold F.O.B. Duct-O-Wire Company's shipping point. Minimum order is $200.00 List.
